When will NCC 2022 be adopted in NSW?

It is important to be aware of when the new National Construction Code (NCC) requirements will apply to your construction projects. It is critical to pay attention to your project schedule, and when you will be submitting applications for development or construction approval. In this article find out when NCC 2022 provisions will apply in NSW.

What was agreed nationally?

Building Ministers announced the publication and adoption schedule for NCC 2022 following their meeting on 26 August 2022.

NCC 2022 will be published on 1 October 2022, with most provisions taking effect on 1 May 2023. Minsters agreed to an extended transition time for the energy, condensation, and livable housing provisions, which will take effect on 1 October 2023.

How will the new NCC 2022 be implemented in NSW?

The NSW government will be following the national adoption timeline. However, the livable housing provisions will not be adopted in NSW.

Most reforms will apply to applications for construction approval (CC or CDC) submitted on or after the adoption date.

What about BASIX?

Following the decision on changes to the NCC 2022 energy efficiency provisions nationally, the NSW Government also announced the equivalent changes for NSW that will apply under BASIX – for more information see last month’s NHS article titled NSW Government announce BASIX changes.

These changes are intended to be adopted in alignment with NCC 2022 energy provisions on 1 October 2023.

A transitional arrangement will mean the BASIX reforms will apply to applications for development consent or modification to consent submitted on or after the adoption date, rather than at application for a CC or CDC.

NSW NCC 2022 and BASIX timeline

In NSW the following implementation timeline will therefore apply:

  • 1 October 2022 - Final publication of NCC 2022
  • 1 May 2023 - Most NCC 2022 changes apply to applications for CC or CDC
  • 1 October 2023 - Condensation management provisions apply to applications for CC or CDC
  • 1 October 2023 - New BASIX requirements apply to applications for DA or CDC, and applications for modification of development consent
  • 1 September 2025 - Low lead plumbing product requirements apply to products installed
